Welcome to Bookly, a note-taking and productivity application that helps you organize notes, books, tasks, calendar events, and reminders. These Terms of Service ("Terms") apply to your use of the Bookly application, website, and related services (collectively, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Acceptance of Terms
By using Bookly, you confirm that you have read and understood these Terms and agree to follow them. If you use Bookly on behalf of another person or organization, you must have permission to accept these Terms on their behalf.
2. Eligibility
You may use Bookly only if you can legally agree to these Terms under the laws that apply to you. If you are not legally able to agree to these Terms on your own, you must have any permission or involvement required from a parent, guardian, or other legally authorized person.
You are responsible for ensuring that your use of Bookly complies with applicable laws and regulations.
3. User Accounts and Security
Some features may require you to create an account. When creating and maintaining an account, you agree to:
- Provide accurate information when requested.
- Keep your login credentials private and secure.
- Take reasonable steps to prevent unauthorized account access.
- Notify us if you become aware of unauthorized use of your account.
- Use only accounts you are authorized to access.
You are responsible for activity performed through your account, except where applicable law provides otherwise. We may take reasonable steps to protect accounts and the Services from fraud, abuse, or security threats.
4. Acceptable Use
You agree to use Bookly responsibly. You must not use the Services to:
- Violate applicable laws, regulations, or the rights of others.
- Access another person's account or data without authorization.
- Upload or distribute malicious software, harmful code, or content intended to disrupt systems.
- Attempt to bypass authentication, security controls, or access restrictions.
- Interfere with the availability, integrity, or normal operation of the Services.
- Use automated methods to abuse or overload the Services.
- Infringe copyrights, trademarks, privacy rights, or other legal rights.
- Reverse engineer, decompile, or modify the software except where applicable law permits this restriction to be overridden.
- Use Bookly for fraudulent, deceptive, or otherwise unlawful activities.
We may investigate suspected misuse and take proportionate action when reasonably necessary to protect users, the Services, or third parties.
5. Your Notes and Content
You may create or store notes, documents, drawings, tasks, events, and other material through Bookly ("User Content"). As between you and Bookly, you retain your rights to your User Content.
You are responsible for your User Content, including ensuring that you have the rights and permissions necessary to store and use it through Bookly.
To operate the Services, you grant Bookly permission to host, store, process, transmit, and display your User Content only as reasonably necessary to provide, maintain, secure, and improve the functionality you use, subject to applicable law and our applicable privacy disclosures.
You must not upload content that you are legally prohibited from sharing or storing, or content that violates the rights of others.
Bookly does not claim ownership of your personal notes simply because you create or store them in the app.
6. Data, Cloud Sync, and Privacy
Bookly may provide local storage, account-based synchronization, or other data features depending on the functionality available in your version of the app and your account settings.
- Some information may be stored locally on your device.
- Cloud synchronization may require an internet connection and a signed-in account.
- Synchronization can be delayed or interrupted by connectivity, device, or service issues.
- Information stored only on your device may not be available on another device.
- You are responsible for protecting access to your devices and account.
Our collection and handling of personal information should be explained in a separate Privacy Policy. These Terms do not replace that policy.
7. Availability, Updates, and Backups
We may update, change, maintain, suspend, or discontinue features of Bookly from time to time. We may also release software updates to address bugs, security concerns, compatibility, or functionality.
We aim to keep Bookly useful and reliable, but we cannot guarantee that the Services will always be available, uninterrupted, compatible with every device, or free of errors.
Unless a feature explicitly provides otherwise, Bookly should not be treated as your only backup or permanent archive. Maintain independent copies of important notes and other information where possible.
Do not rely on Bookly as the sole place to store information whose loss could cause serious harm. We do not promise that deleted or lost data can always be recovered.
8. Intellectual Property
The Bookly name, branding, logos, application software, interface design, and other materials created for Bookly are owned by their respective owners and are protected by applicable intellectual property laws.
These Terms give you a limited, personal, non-exclusive, non-transferable right to use the Services for their intended purpose, subject to these Terms. They do not transfer ownership of Bookly's software or branding to you.
You may not copy, redistribute, sell, or commercially exploit Bookly's protected materials without authorization, except where applicable law permits it.
9. Third-Party Services
Some features may depend on third-party services, platforms, operating systems, or infrastructure. Those services may have their own terms, privacy practices, availability limits, and requirements.
Bookly is not responsible for third-party services that it does not control. This does not exclude responsibilities that cannot legally be excluded.
10. Suspension and Termination
You may stop using Bookly at any time. If account deletion is available, review the applicable instructions before proceeding, especially if you need to preserve information.
We may restrict, suspend, or terminate access where reasonably necessary to address serious violations of these Terms, legal obligations, security threats, fraud, or risks to other users or the Services.
Where reasonably practicable and legally permitted, we will seek to provide notice or an opportunity to resolve an issue before taking significant action. This may not be possible in urgent security or legal situations.
Ending your use of Bookly does not automatically mean that every copy of your data has been immediately deleted from all systems. Any data retention and deletion practices should be described in the applicable Privacy Policy.
11. Disclaimers and Limitation of Liability
To the extent permitted by applicable law, Bookly is provided on an "as is" and "as available" basis. We do not guarantee that every feature will meet every user's needs or that errors and interruptions will never occur.
To the extent permitted by law, Bookly and its operators will not be liable for indirect, incidental, special, or consequential losses arising from use of the Services, including loss of data, business interruption, or inability to access the Services.
Nothing in these Terms excludes or limits liability, warranties, or consumer rights that cannot lawfully be excluded or limited in your jurisdiction.
12. Changes to These Terms
We may update these Terms to reflect changes to Bookly, security practices, legal requirements, or how the Services operate.
When we make changes, we will update the date shown at the top of this page. Where required by applicable law, we will provide additional notice or obtain consent for material changes.
Your continued use of Bookly after updated Terms take effect will constitute acceptance only where such acceptance is legally effective. If you do not agree to the revised Terms, you should stop using the affected Services.
13. Contact
If you have questions about these Terms, contact the Bookly team through an official support channel published on the Bookly website or in the application.
Please do not include passwords, authentication codes, or other sensitive account credentials in support messages.
